Resale FAQ’s

Some of the information required in an Estoppel certificate are:

  • The regular periodic assessments (dues) levied against the property.
  • What date the regular periodic assessment is paid through.
  • When the next installment is due and the amount.
  • An itemized list of any additional assessments, special assessments, and other moneys that are scheduled to become due.
  •  If there is a capital contribution fee, resale fee, transfer fee, or other fee due and the amount.
  • If there are any open violations on the property.
  • If there is buyer approval required by the board of directors of the association.
  • If there is right of first refusal and if so, has the association exercised that right.

A lender questionnaire is a document required by lenders to finance a property designated as a condominium or a townhouse that is a part of a homeowner’s association. The document provides evidence that the condominium or homeowner’s association is in compliance with lender’s underwriting requirements.

The Association’s Governing Documents are the legal documents that dictate how an association must operate and include the following: Articles of Incorporation, Bylaws, Declaration of Covenants, Conditions and Restrictions (CC&Rs).
